1. Terms and conditions

1.1 Definitions

Platform – the web application “Luxury Real Estate Calculator Pro 2025”, including any sub-domain or mobile extension.
User / Client – the natural or legal person who creates an account, accesses or purchases usage packages through the Platform.
Usage package – a limited, non-exclusive and revocable right to generate a predetermined number of reports/calculations through the Platform.

1.2 Acceptance of terms

By accessing or purchasing any service, the User confirms that:

a) he/she has read, understood and fully accepted this document;

b) he/she has full legal capacity or, if a minor, the consent of his/her legal representative;

c) the data provided is accurate and complete.

1.3 User rights and obligations

Rights:
- 24/7 access to the Platform, except during maintenance periods;
- use of report results exclusively for own, non-commercial purposes, unless a “Business” licence has been purchased.

Obligations:
- not to exploit vulnerabilities;
- not to perform reverse-engineering, scraping, or any action that could affect Platform security;
- not to share access credentials;
- not to use the results for unlawful, discriminatory purposes or in violation of third-party rights.

1.4 Provider rights and obligations

Rights:
- to suspend or restrict access in case of Terms violation;
- to modify functionalities, prices or this document with 15 calendar days prior notice by e-mail and publication on the website.

Obligations:
- to ensure Platform availability of at least 99 % monthly (excluding scheduled maintenance);
- to provide technical support by e-mail (lrec@pozitron.ro) within 48 h on business days; to maintain data confidentiality in accordance with the Privacy Policy and GDPR legislation.

1.5 Licence of use

The “Business” package grants the right to redistribute to the User’s end-clients, exclusively in the form of undeveloped PDF reports (without access to the Platform’s source code).

1.6 Limitation of liability

The Provider is not liable for:
- errors resulting from incorrect data entered by the User;
- indirect loss of profit, business or opportunities;
- Platform unavailability due to force majeure (solar storms, extensive power outages, major cyber-attacks).

1.7 Applicable law and dispute resolution

Legal relations are governed by Romanian law. Disputes shall be settled amicably within 15 days; otherwise, the courts at the Provider’s registered office (Bucharest, Romania) shall have jurisdiction.

2.2 Types of data collected

Identification data: name, surname, personal numeric code (optional), ID card series/number (only for individual invoicing).
Contact data: e-mail, phone, address.
Transaction data: payment trail, transaction ID, amount, date/time.
Technical data: IP, browser type, operating system, access log.

2.3 Legal bases (Art. 6 GDPR)

Contract performance – account creation and delivery of the usage package.
Legal obligations – issuing invoices, reporting to the tax authority.
Legitimate interest – fraud prevention and service improvement.

2.4 Recipients of data

Payment processor Netopia (card data are neither stored nor accessed by us); hosting provider (anonymised technical data);

tax authorities, upon request.

2.5 Retention period

Active account: for the lifetime of the account + 3 years for fiscal archiving. Deleted account: 30 days for complete erasure, except data required for fiscal records (7 years).

2.6 User rights

right of access – obtain a copy of the data;
right to rectification – correct inaccurate data;
right to erasure (“right to be forgotten”) – except for legal obligations;
right to restriction – suspend processing;
right to data portability – receive data in a structured, usable format;
right to object – unsubscribe from marketing communications;
right not to be subject to automated decision-making – we do not perform significant profiling.

3. Order delivery policy

3.1 Service description

Luxury Real Estate Calculator Pro delivers digital services (usage packages) instantly, immediately after payment confirmation.

3.2 Delivery steps

Order placement – the User selects the desired package and completes payment through Netopia.
Payment confirmation – the processor notifies the Platform within 30 seconds.
Credits activation – the purchased number of uses is added instantly to the User’s account.

3.3 Delivery means

Web platform – access by logging into the account;
Confirmation e-mail – sent automatically to the registered address, containing the number of uses.

3.4 Costs and deadlines

Delivery cost: 0 RON – the service is delivered online.
Deadline: instant (under 1 minute from payment).
Platform availability: 24/7, including weekends and legal holidays, except for server, internet functioning issues and announced maintenance.

4. Order cancellation policy

4.1 Right of withdrawal (Art. 16-17 GEO 34/2014)

Since our services are digital and fully performed before the expiry of the 14-day withdrawal period, the User expressly waives the right of withdrawal by completing the payment (Art. 38 let. m) of GEO 34/2014).

4.2 Exceptions to waiver

Payment errors caused by the processor – we will fully refund within 7 calendar days;
Major Platform malfunctions – if credits cannot be used due to our fault, we offer either a refund or replacement with an equivalent package.

4.3 Request procedure

Send an e-mail to lrec@pozitron.ro with the subject “Order cancellation – transaction ID”. We will reply within 24 h (business days).
